1. About these terms
1.1 Cellar Door Days (the Site) is operated by David, an individual based in New South Wales, Australia (we, us, our). You can contact us at hello@cellardoordays.com or through our contact page.
1.2 These terms form an agreement between you and us. If you do not agree to them, you must not use the Site.
1.3 Your use of the Site is also governed by our privacy policy, which forms part of these terms.
2. Eligibility
2.1 The Site concerns visiting cellar doors and other licensed premises and is intended for individuals aged 18 and over. By using the Site, you confirm that you are at least 18 years of age.
3. Alcohol, transport and safety
3.1 It is unlawful in every Australian state and territory to sell or supply alcohol to a person under 18, and venues may ask for proof of age.
3.2 A sequence of tastings can accumulate faster than expected. Measures poured at a cellar door are intended for tasting, and there is no reliable way to judge your own blood alcohol concentration from how you feel.
3.3 The trip planner is not, and must not be treated as, a representation that you are fit to drive. A travel time between two venues describes the road, not your condition. If you intend to taste, you must arrange a driver, a tour, a shuttle or accommodation. The planner supports each of those as a travel mode or overnight base and will plan a route in which you do not drive.
3.4 Please drink responsibly. If you need support, Counselling Online (counsellingonline.org.au) and the National Alcohol and Other Drug Hotline (1800 250 015) are free and confidential.
4. Accuracy of information
4.1 We take care to keep venue details accurate and indicate where a detail is unverified. However, opening hours change, kitchens close, fees rise and venues shut permanently, often without notice and without updating their own sources.
4.2 You must confirm details directly with a venue before you travel, particularly for anything requiring a booking and particularly on public holidays. Travel times and costs are estimates. Prices are those we last recorded, in Australian dollars, and are a guide rather than a quote.
5. Independence and commercial relationships
5.1 The Site is independent and free to use. It carries no affiliate links, no sponsorship and no advertising, and no venue can pay to be listed, to rank higher, or to change how it is described. Every venue in a region is included on the same terms, from our own research.
5.2 If this ever changes (for example, if affiliate links are introduced), we will disclose the relationship clearly and update these terms and our privacy policybefore doing so.
6. Your trip
6.1 A trip you build is stored in your own browser and not on our servers. Clearing your browser data will delete it. A shared trip link contains the plan itself; anyone with the link can open it, so you should treat it as public.
7. Accounts
7.1 We sign you in using a single-use link sent to your email address. You are responsible for keeping access to that mailbox secure, as anyone able to read your email may be able to sign in as you. Please tell us promptly if you believe your account is being used by someone else.
7.2 You may close your account at any time.
8. Reviews and other content you submit
8.1 When you submit a review or a photo, you warrant that:
- you visited the venue and the review reflects your own genuine opinion;
- the photos are yours to share and you have the consent of any identifiable person in them;
- the content is not defamatory, misleading, abusive, unlawful, or an advertisement;
- you were not paid or otherwise induced by the venue to submit it.
8.2 You retain ownership of the content you submit. You grant us a non-exclusive, royalty-free, worldwide licence to host, reproduce and display that content on the Site and in material promoting the Site. That licence ends for future uses when your content is removed, save for copies already cached or indexed by third parties, which are beyond our control.
8.3 Reviews are moderated before publication. We may decline or remove any content that breaches clause 8.1, and we may suspend or terminate an account that repeatedly does so. Reviews express the views of their authors, not ours.
8.4 If you are a venue and consider a review to be false or unlawful, contact us through the contact page and we will assess it. We will not remove a review merely because it is unflattering.
9. Our content and intellectual property
9.1 The written descriptions, guides, dataset, software and design of the Site are owned by us or licensed to us. Map and geographic data are derived from OpenStreetMap under its own licence; see our data and licensing page.
9.2 You must not scrape, extract or republish the dataset. If you wish to use it, please ask us first.
10. Third-party sites and services
10.1 Links to venue websites, booking platforms and mapping services are governed by those services' own terms and privacy policies, not ours. Any booking or purchase you make with a venue or operator is a contract between you and them; we are not a party to it and are not responsible for resolving disputes arising from it.
11. Liability
11.1 The Site is provided on an "as is" and "as available" basis, for general guidance only. To the maximum extent permitted by law, we exclude liability for any loss or damage arising from your use of, or reliance on, the Site, including a venue that had closed, a fee that had changed or a route that took longer than estimated.
11.2 Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to theCompetition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Where our liability for a failure to comply with such a guarantee can be limited, our liability is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.
12. Indemnity
12.1 To the extent permitted by law, you agree to indemnify us against any claim, loss or cost we reasonably incur arising from content you submit or from your breach of these terms, except to the extent it is caused by us.
13. Suspension and termination
13.1 We may suspend, restrict or terminate your access to the Site or to account features where you breach these terms or where reasonably necessary to protect the Site or its users. You may stop using the Site, and close your account, at any time.
14. Changes to these terms
14.1 We may update these terms as the Site changes. The date at the top records when they were last updated. Continuing to use the Site after a change means you accept the updated terms.
15. Governing law
15.1 These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State.
